Dispute Resolution & Arbitration Clause

  1. Resolution of DisputesAny dispute, claim, or controversy arising out of or in connection with these Terms and Conditions, Privacy Policy, or any other agreement related to the use of the Myslotmate platform shall be resolved initially through informal negotiations between the parties. If the dispute remains unresolved after thirty (30) days from the date the dispute is raised, the parties agree to submit the matter to binding arbitration as described below.
  2. ArbitrationAny unresolved dispute, claim, or controversy will be settled through binding arbitration under the rules of the Arbitration and Conciliation Act, 1996 (India). The arbitration proceedings will take place in Guwahati, India, and the language of arbitration will be English. The arbitrator’s decision will be final and binding on both parties.
  3. Arbitrator's AuthorityThe arbitrator will have the authority to award remedies available under applicable law. The arbitrator cannot award punitive, incidental, or consequential damages, except as permitted by law. The arbitrator’s decision may be enforced in any court of competent jurisdiction.
  4. Waiver of Class ActionBy agreeing to these Terms and Conditions, both parties waive their right to pursue any dispute on a class-action or representative basis. All claims must be brought individually, and the arbitrator shall not have authority to hear any class action or similar proceeding.
  5. Costs of ArbitrationEach party shall bear its own costs and expenses related to the arbitration, including legal fees, unless the arbitrator rules that a party has acted in bad faith, in which case, the prevailing party may be awarded costs.
  6. Interim ReliefNotwithstanding the above, either party may seek interim or urgent relief in a court of competent jurisdiction, located in Guwahati, India, to preserve their rights or prevent harm that cannot be adequately addressed by arbitration.
  7. Governing LawThis Dispute Resolution & Arbitration Clause shall be governed by and construed in accordance with the laws of India.
  8. SeverabilityIf any provision of this clause is found to be invalid or unenforceable by a court or arbitrator, the remaining provisions will continue in full force and effect.
